Terms & Conditions

1. Scope of Engagement

These Terms and Conditions govern all commercial photography, cinematic film production, creative direction, and digital services provided by Portrait Marker Visual Agency ("the Agency") to the commissioning client ("the Client"). By commissioning a shoot, executing a service agreement, or submitting a deposit, the Client agrees to be bound by these Terms.

2. Production Reservations & Deposit Terms

A non-refundable production retainer of 50% of the total project value is required to reserve studio dates, crew schedules, and equipment rentals. The remaining 50% balance is due upon presentation of watermarked proofs prior to the release of high-resolution deliverables.

3. Rescheduling & Weather Contingencies

Production reschedules requested by the Client more than 7 business days prior to the shoot date will be accommodated without penalty, subject to studio availability. For outdoor location shoots compromised by adverse weather, the Agency and Client will mutually agree upon an alternate production window.

4. Intellectual Property & Commercial Usage Rights

Unless explicitly stipulated otherwise in an executed master service agreement, the Agency retains statutory copyright in all raw visual materials, rushes, and creative concepts. Upon receipt of full payment, the Client is granted an exclusive, worldwide commercial license for the agreed media channels and campaign duration.

5. Turnaround & Delivery Standards

Standard preview galleries are delivered within 5 to 7 business days following shoot wrap. Final color-graded and retouched master deliverables are released within 10 to 14 business days following receipt of the Client's finalized select list.

6. Limitation of Liability

The Agency maintains standard commercial liability coverage. In the unforeseen event of catastrophic equipment failure or data loss, the Agency's total aggregate liability shall not exceed the fees paid by the Client for the specific engagement.
